Burma'a starlin Than shwe's Wonderful crap constitution; Oh how wonderful !!!

Tatmadaw Constitution for Disciplined Democracy in Burma - ha ha ha

1.   25% of seats in both the upper and lower houses of the parliament
are designated for tatmadaw member appointed by the supreme
commander.
2.   The tatmadaw bear responsibility for "safeguarding the State
Constitution." That principle could be invoked at any time to prevent
amendments that the military sees as inimical to its interests. The
Chief of Staff and the army will be above the state judiciary system,
and can manipulate it as they choose; imposing martial law and ousting
the civilian administration if it is deemed to pose a threat to
national security. The military is vested with veto power to declare a
state of emergency virtually anytime it wants without parliamentary
oversight and dissolve the parliament.
3.   The principles also guarantee the military a place in the executive
branch as the President will be elected only after the military's
approval. The President is to be invested with enormous power and will
work independently from the legislature and be granted immunity from
prosecution.
4.   The supreme commander will be the defence mi
ister and he will
report directly to the president. Under the draft constitution, "The
tatmadaw has the right to independently administer all affairs
concerning the armed forces." The commander in chief is also given
full control over military justice.
5.   Critical postings such as the defence minister, home minister and
Border Area Affairs shall be appointed from within the military
regime.
6.   The military regime shall be a government within a government and
have a separate budget controlled by the supreme commander.
7.   The constitution can only be changed by not less than 75% of the
parliamentarian votes. Thus once accepted the constitution it is
impossible to change.
8.   Three vice president positions would be filled by a presidential
Electoral College comprised of members selected by the People's
Parliament; the Electoral College would then elect a president from
among the three vice presidents who will be well acquainted with
military affairs.
9.   The junta, in Chapter 14 of its draft constitution, provides
immunity to all military officials from being tried and prosecuted,
which groups including the Burma Lawyers Council, Global Justice
Centre and Burma Justice Committee said is totally against
international law. Article 445 of the junta's draft constitution
states that, "No legal action shall be taken against those (either
individuals or groups who are members of SLORC and SPDC) who
officially carried out their duties according to their
responsibilities."

The above 9 points are hardly democratic !. One wonders if the
generals understand what democracy means?. There was a sham
Referendum. It was done when people were in trouble due to cyclone
diaster. The country people were not informed what the constitution
was all about. Discussion on the referendum was not allowed. The
people in the villages were not aware of what was going on. People
were bulldozed into accepting it. President Thein Sein was the
chairman of the referendum committee and all the delegated were 3Yes
men4 hand picked by the junta. How can he be serious with reform? The
hand pick delegates were in this convention to accept what ever the
junta demanded knowing full well that it was all undemocratic but dare
not oppose it due to unpredictable punishment from dictator Than Shwe
who has threatened them. So the convention was not free and open.
Before referendum voting day all the arm force personnel were forced
to vote 3yes4 before their commanding officer. All government servants
who were previously told that they should not get involved in politics
were called in and forced to vote 3yes4 in front their supervisors and
superiors and if they voted 3NO4, they were forced to resign from the
jobs and then they and their family were harassed unlawfully. The USDA
the junta thugs were every where threatening people to vote 3yes4. The
junta USDA thugs would accompany the voter into the polling boot and
force the people to vote 3Yes4. If they did not they were marked and
they had to suffer harassment and even close down their business to
put then out of action. It was a bully tactic and they went about
punishing those people who voted 3NO4. That was the junta way to
disciplined democracy. People could not file a complaint. It was
ignored because the election commission was made up of the Junta2s
men. It was a total mockery to openness, transparency and free and
fair voting practice which was taken for granted in the western
democracy. The western government and even ASEAN came forward to
assist and help in the voting process but the junta said that they had
lots of experience in election processes and did not need help nor
observers and they did what they like and lied to the people with
false propaganda via the new light of Myanmar. There were no freedom
of speech, press, assembly and information. It was a total sham and
absolute disaster to the dismay of the people of Burma. Dictator Than
Shwe was pleased with himself that he managed to bully the people.
Than Shwe ordered the election commission exactly what to do. Than
Shwe installed his own men in the commission so that every thing will
be as he planned. The election commission was issuing threats to the
people before the election. When Election Day came the same thing
happened. The junta told the world that they had lots of experience in
election processes and did not need help, supervision nor observers.
Aung San Suu Kyi was due to be released but she was still kept under
house arrest unfairly so that the junta party USDP will have a free
upper hand. The world was watching. The junta USDA thugs accompanied
the voter into the polling boot, intimidated people and force them to
vote for the junta2s USDP party. The arm force personnel were forced
to vote for USDP openly in front of their commanding officer. No
ballot was secret. All government servants who were previously told
that they should not get involved in politics were called and forced
to vote for USDP and show their supervisors and superiors who they
voted for !!!. Such was the fairness of the election process. The
people were in fear and dare not complain or voice their
dissatisfaction, otherwise their names were added to the black list
and the punishment was severe for the family. The family could not
afford the bread winner to be jailed for 65 years. The generals were
manipulating the judiciary, de-registered/banned the NLD party and
used the State media as their mouth piece to deceive and mislead the
people as though Burma was owned by the junta..
Who can honestly say that the junta was looking after its people ?.
How can this rigged election that was based on a sham referendum and
which was not accepted by the people - be valid ???. One has to
conclude that this Thein Sein government is illegal in the eyes of the
law; and the generals broke their own law !. It was a mockery. If the
referendum was illegal then how can the election be creditable and
legal?. The NLD refused to take part in this election and for that
they were de-registered. How fair can that be ?. These uneducated,
crooked, corrupted, trigger happy, power hungry, self promoted so
called generals are obviously not worthy of being in government. The
junta was creating a climate to continue military rule in the guise of
such a sham election to legitimise their rule which was condemned by
the people. These faceless generals applause the election and took
their seats in the parliament as though they were legitimately elected
by the people !!. It has been made abundantly clear to the junta by
the UN, NATO, Western Governments, European Union, the US, ASEAN and
the World Community including Asian-pacific nations that the election
was illegitimate and not acceptable. Do you think the generals in
civilian clothes care ??. Now they want Suu Kyi in parliament to
obtain international legitimacy.
This government should step down, apologise to the people, ask for the
people forgiveness for all the murders and rapes committed and arrange
to draw up a new constitution with the participation of the people in
whom the power lies. The corrupted generals must account to the
people, compensate for the misery brought on to the people and pay for
their crimes. This is the only honourable act to bring peace and
repair the damage done to the people.
